That footage triggered an onslaught of new charges against members of the now-closed Beta Theta Pi fraternity, including involuntary manslaughter, hazing and providing alcohol to a minor, Miller said.

A slew of new charges were announced Monday - including aggravated assault and involuntary manslaughter - against former members of the Penn State fraternity accused of being involved in the hazing death of 19-year-old sophomore Timothy Piazza.

"It was obvious what occurred", she said, "I don't think we should have needed it, I think it's obvious what happened without having the video".

The Piazzas declined to comment on the ruling, but District Attorney Stacy Parks Miller said they were "shocked" by the decision, according to Philly.com.

The detective also found a reference to a line of video being "deleted", and he was told by the manufacturer that it indeed meant that basement video footage had been deleted.

Police had already confiscated video footage from the house's main floor, which showed Piazza stumbling and repeatedly falling and hitting his head in an obvious drunken stupor, and thrashing about or rolling on his fraternity's floor, showing what would be the last signs of life.

The defendants have denied all charges. That assault charge was dropped but now Joseph Ems faces new charges of hazing, furnishing alcohol and unlawful acts relative to liquor. These refiled charges are accompanied by a Motion to have a new Magistrate appointed for a new preliminary hearing.

"He deleted it in front of the police", Parks Miller said, adding that the forensic analysis showed Becker made "a series of deliberate commands" on the machine to delete the basement portion of the video.
